The Internal Audit Department of the Orange County Transportation Authority has  
completed an audit of the Contractor Safety Management Program. Based on the audit,  
the program could be improved by revising policy and safety specifications to better align  
with expectations, developing methods to ensure applicable project managers are  
identified and aware of their responsibilities, providing timely training and/or instructions to  
project managers, and formalizing the process for documenting safety activities and  
reporting within the Origami system.

Overview  
The Orange County Transportation Authority oversees the operations of the 405 Express  
Lanes, which commenced on December 1, 2023. During the month of December 2025,  
transactions increased 11.5 percent while trips grew by 12.4 percent on the 405 Express  
Lanes. For the quarter ending December 2025, transactions totaled 18.5 million and trips  
were 4.7 million. This report focuses on the operational and financial activities for the  
period ending December 31, 2025.

Overview  
The Orange County Transportation Authority has owned and managed the operations of  
the 91 Express Lanes since January 2003. Since then, traffic volumes and toll revenues  
have fluctuated with changes in the economy and the added capacity to the State Route 91  
corridor. During the month of December 2025, approximately 1.86 million trips were taken,  
and over 5.57 million trips were made during the last quarter of calendar year 2025 on the  
91 Express Lanes in Orange County. This report focuses on the operational and financial  
activities for the period ending December 31, 2025.

Overview  
The 91 Express Lanes Riverside County Transportation Commission / Orange County  
Transportation Authority Facility Agreement prescribes the funding transfers between the  
two agencies for costs incurred for the rental of administrative offices and any shared  
operational expenses in relation to the 91 Express Lanes. An amendment is needed to  
account for the reimbursement of anticipated shared operating costs incurred by the  
Riverside County Transportation Commission for the period July 1, 2026, through June 30,  
2027.  
Recommendation  
Authorize the Chief Executive Officer to negotiate and execute Amendment No. 11 to  
Agreement No. C-5-3828 between the Orange County Transportation Authority and the  
Riverside County Transportation Commission in the amount of $550,000 for the  
reimbursement of shared operational expenses through June 30, 2027.

The Orange County Transportation Authority has a comprehensive investment and debt  
program to fund its immediate and long-term cash flow demands. Each month, the

report detailing investment allocation, performance, compliance,  
outstanding debt balances, and credit ratings for the Orange County Transportation  
Authority’s debt program. This report is for the month ending February 28, 2026. The report  
has been reviewed and is consistent with the investment practices contained in the  
investment policy.

State Legislative Status Report

Overview  
The Orange County Transportation Authority provides regular updates to the Legislative  
Committee on policy issues directly impacting its overall programs, projects, and  
operations. Staff recommends support positions on six bills that are related to California  
Environmental Quality Act streamlining, zero-emission transit implementation, wildfire  
resilience, transportation funding policy, and transit-oriented development. Staff opposes  
positions on two bills that would significantly alter state transportation funding priorities and  
reduce regional flexibility. An overview is also provided on legislation related to California  
Environmental Quality Act vehicle miles traveled mitigation requirements, for which a  
support position was taken pursuant to Orange County Transportation Authoritys 2025-26  
State Legislative Platform.  
Recommendation(s)  
A.  
Adopt a SUPPORT position on AB 1855 (Gonzalez, R-Indio), which would expand  
California Environmental Quality Act exemptions for passenger rail projects.

Adopt a SUPPORT position on AB 1944 (Lee, D-Milpitas), which would establish a  
phased extension of axle weight allowances for zero-emission transit buses to  
support fleet transition requirements.

operations. This report provides a summary of President Trump’s Fiscal Year 2027  
Budget Request and its implications for federal transportation funding and policy. It also  
includes an overview of a congressional letter supporting restoration of local Surface  
Transportation Block Grant and Congestion Mitigation and Air Quality Improvement  
Program project selection authority, and a summary of recent congressional leadership  
changes affecting federal transportation policy.

The Laguna Beach Municipal Transit Lines, a department within the City of Laguna Beach,  
is eligible to receive funding from the Local Transportation Fund in Orange County for  
providing public transportation services throughout the city. To receive the funds, the  
Laguna Beach Municipal Transit Lines must file a claim against the Local Transportation  
Fund with the Orange County Transportation Authority.

Authority.

Approve the Orange County Transit District Fiscal Year 2026-27 Local  
Transportation Fund Claim for public transportation services in the amount of  
$205,036,189, and for community transit services in the amount of $10,869,295 for  
a total claim amount of $215,905,484.

to the Orange County Auditor-Controller in the full amount of the claims.

Overview  
On June 24, 2024, the Board of Directors approved a cooperative agreement with the  
Regional Center of Orange County to share in the cost of providing paratransit service to  
individuals served by the Regional Center of Orange County. The agreement included an  
initial two-year term with two additional two-year option terms. The initial term of the  
agreement expires on June 30, 2026, and an amendment is required to exercise the first  
two-year option term of the agreement.  
Recommendation(s)  
Authorize the Chief Executive Officer to negotiate and execute Amendment No. 1 to  
Cooperative Agreement No. C-4-2328, in the amount of $10,257,017, between the  
Orange County Transportation Authority and the Regional Center of Orange County to

Overview  
To comply with the California Air Resources Board’s Innovative Clean Transit Rule, the  
Orange County Transportation Authority is actively operating and expanding a mixed fleet  
that includes battery-electric buses and fuel-cell-electric buses, while continuing to build the  
operational experience necessary to transition to a fully zero-emission fleet by 2040. As  
part of this required transition, a critical infrastructure gap has emerged following the  
expiration of the long-term hydrogen fueling station contract. To maintain operations for  
existing and incoming fuel-cell-electric buses, staff has developed a request for proposals  
to procure two hydrogen mobile fueling stations as an interim solution.

Approval to Sell Surplus Land for the Interstate 5 Improvement Project Between  
State Route 73 and Oso Parkway

Overview  
The Orange County Transportation Authority’s Interstate 5 Improvement Project between  
State Route 73 and Oso Parkway required the acquisition of property rights from public  
and private parties, adjacent to the existing freeway and city streets. Now approximately  
10,148 square feet of vacant commercial property, located at the corner of Camino  
Capistrano and Avery Parkway in the City of Laguna Niguel and identified as Assessor  
Parcel No. 637-231-01, is recommended to be sold as surplus land by the Orange County  
Transportation Authority. Therefore, staff is seeking approval to sell the vacant land as  
surplus land under the Surplus Land Act (Government Code Section 54220 et seq.).

Overview  
On May 24, 2021, the Orange County Transportation Authority Board of Directors  
approved a cooperative agreement with the County of Orange for programs that expand  
mobility choices for seniors and individuals with disabilities under Project U, including  
Measure M2 funding support for the County of Orange Senior Non-Emergency Medical  
Transportation Program. The agreement includes a five-year initial term with a five-year  
option term. The initial term expires June 30, 2026. Staff is requesting the Board of  
Directors’ approval to exercise the five-year option term effective July 1, 2026, through  
June 30, 2031.

Authorize the Chief Executive Officer to negotiate and execute Amendment No. 2 to  
Agreement No. C-1-3446 between the Orange County Transportation Authority and the  
County of Orange to exercise the option term for continued Measure M2 funding for the

Measure M2 Ten-Year Review Report and Action Plan

Overview  
Approved by Orange County voters in 2006, the Renewed Measure M Transportation  
Investment Plan established a 30-year, half-cent sales tax program. Ordinance No. 3, the  
governing ordinance, includes a taxpayer safeguard provision to conduct a comprehensive  
review of the project and program elements of the Renewed Measure M Transportation  
Investment Plan at least every ten years. The results of the first ten-year review were  
presented to the Board of Directors on October 12, 2015. Efforts for the second review,  
consistent with the Board of Directors-approved framework, have been completed. The  
final Ten-Year Review Report is presented to the Orange County Transportation Authority  
Board of Directors for information along with an accompanying Action Plan for  
consideration.

Overview  
On April 1, 2026, Renewed Measure M, also known as Measure M2, reached a significant  
milestone, marking the halfway point of the voter-approved 30-year program. Over the past  
15 years, Measure M2 has delivered significant transportation investments across Orange  
County, including advancing major freeway improvements, enhancing streets and roads in  
every city, expanding transit options, and funding programs that protect our environment.  
This milestone provides an opportunity to reflect on the progress achieved to date and to  
reaffirm the Orange County Transportation Authority’s commitment to fulfilling the  
improvements promised to voters.
