Overview  
On an annual basis, the Orange County Transportation Authority (OCTA) conducts  
meetings with rating agencies, financial institutions, and other key stakeholders in New  
York. This year, OCTA representatives will meet with New York-based analysts to discuss  
various topics affecting the agency, including the Interstate-405 Express Lanes, the 91  
Express Lanes, the Measure M2 Program, sales tax collections, the Fiscal Year 2025-26  
approved budget, and the state of the local economy. The meetings are scheduled with  
Moody’s Investors Service, Fitch Ratings, Standard & Poor’s, and other interested parties.  
These discussions will take place during the week of July 28, 2025.

Approve the travel to New York for Chair Doug Chaffee, Vice Chair Jamey M. Federico,  
and Finance and Administration Committee Chair Michael Hennessey for the Orange

Overview  
The Finance and Administration Committee of the Board of Directors of the Orange  
County Transportation Authority serves as an audit committee in its oversight of audit  
activities. Annually, the Board of Directors approves the audit responsibilities of the  
Finance and Administration Committee to reaffirm these responsibilities.

Overview  
The Orange County Transportation Authority has a comprehensive investment and debt  
program to fund its immediate and long-term cash flow demands. Each month, the  
Treasurer submits a report detailing investment allocation, performance, compliance,  
outstanding debt balances, and credit ratings for the Orange County Transportation  
Authority’s debt program. This report is for the month ending December 31, 2024. The  
report has been reviewed and is consistent with the investment practices contained in the  
investment policy.

Overview  
The Orange County Transportation Authority, as the transportation planning agency and  
county transportation commission for Orange County, is responsible for developing  
estimates used in apportioning revenues earned and deposited in the Orange County  
Local Transportation Fund. Transportation Development Act regulations require that the  
apportionments for fiscal year 2025-26 be determined, and prospective claimants be  
advised of the amounts.  
Recommendation(s)  
Approve the Local Transportation Fund fiscal year 2025-26 apportionment estimates and  
authorize the Chief Executive Officer to advise all prospective claimants of the amounts of  
all area apportionments from the Orange County Local Transportation Fund.

Disadvantaged Business Enterprise Program Update

Overview  
On April 9, 2024, the United States Department of Transportation issued a Final Rule that  
introduced significant amendments to Disadvantaged Business Enterprise Program  
regulations. As these changes are significant, the Orange County Transportation Authority  
must update its Disadvantaged Business Enterprise Program to align with the new  
regulations and submit it for approval by the Board of Directors.

Adopt the proposed revisions to the Orange County Transportation Authoritys  
Disadvantaged Business Enterprise Program and direct staff to implement the  
recommended changes.

State Legislative Status Report

Overview  
The Orange County Transportation Authority provides regular updates to the Legislative  
and Communications Committee on policy issues directly impacting its overall programs,  
projects, and operations. Staff recommends a support position on two pieces of  
legislation: the first related to safety enhancement measures for transit operators,  
employees, and riders and the second related to clarifying the California Environmental  
Quality Act exemptions for certain transit and active transportation projects. An update on  
the Orange County Transportation Authority’s involvement in an Innovative Clean Transit  
Regulation Task Force and details on membership changes to the Senate and Assembly  
committees are included in this report.  
Recommendation(s)  
A.  
Adopt a SUPPORT position on AB 394 (Wilson, D-Suisun City), which would  
strengthen existing safety provisions to protect public transportation operators,  
riders and employees.  
B.  
Adopt a SUPPORT position on SB 71 (Wiener, D-San Francisco), which would  
indefinitely extend and make clarifying changes to California Environmental Quality  
Act exemptions for certain transit and active transportation projects.

Federal Legislative Status Report

Overview  
The Orange County Transportation Authority regularly updates the Legislative and  
Communications Committee on policy and regulatory issues directly impacting the  
agency’s programs, projects, and operations. This status report provides a summary of  
recent executive orders issued by President Trump. An update is provided on the  
confirmation of a new Transportation Secretary and actions that the United States  
Department of Transportation has taken to align with the executive orders. An update is  
also provided on Federal Transit Administration and Federal Railroad Administration  
appointments. Additionally, this report highlights ongoing federal legislative discussions,  
including hearings on highways, freight, and passenger rail networks, with a focus on  
regulatory reforms, permitting challenges, and the economic impacts of federal  
transportation investments.

Overview  
The Orange County Transit District is eligible to receive funding from the Local  
Transportation Fund for providing public transportation services throughout Orange County.  
To receive these funds, the Orange County Transit District, as the public transit and  
community transit services operator, must file claims with the Orange County  
Transportation Authority, the transportation planning agency for Orange County.  
Recommendation(s)  
Adopt Orange County Transit District Resolution No. 2025-007 authorizing the filing of  
Local Transportation Fund claims, in the estimated amounts of $208,460,790 to support  
public transportation and $11,050,352 for community transit services.

Overview  
On June 24, 2024, the Orange County Transportation Authority Board of Directors  
approved a cooperative agreement with the Orange County Adult Achievement Center,  
doing business as My Day Counts, to cost share in the provision of special transit services.  
This cost sharing arrangement, is mutually beneficial to both agencies and provides  
specialized transportation services directly to the My Day Counts programs, thereby  
reducing the demand and cost for OC ACCESS. An amendment to that agreement is  
necessary to address growth in ridership.  
Recommendation(s)  
Authorize the Chief Executive Officer to negotiate and execute Amendment No. 1 to  
Cooperative Agreement No. C-4-2291 between the Orange County Transportation  
Authority and the Orange County Adult Achievement Center, doing business as My Day  
Counts, in the amount of $250,000, to provide funding to support growth in ridership  
through June 30, 2025.

Sole Source Agreement for Hydrogen Fueling Station Operation, Maintenance,

Overview  
On November 13, 2017, the Orange County Transportation Authority Board of Directors  
approved an agreement to install a hydrogen fueling station at the Santa Ana Bus Base to  
provide operation, maintenance, and hydrogen fuel supply. The term of the agreement has  
expired, and Board of Directors’ approval is requested to award a sole source agreement  
to continue hydrogen fueling operations.  
Recommendation(s)  
Authorize the Chief Executive Officer to negotiate and execute Agreement No. C-5-3892  
between the Orange County Transportation Authority and Air Products and Chemicals, Inc.,  
in the amount of $2,460,000, to continue the hydrogen fueling station operation,  
maintenance, and hydrogen fuel supply for a two-year initial term and one, one-year option  
term.

Approval of Refunding the Measure M2 Sales Tax Revenue Bonds, Series 2010 A

Overview  
On October 14, 2024, the Orange County Transportation Authority Board of Directors  
directed staff to pursue refunding of the Orange County Local Transportation Authority  
Measure M2 Sales Tax Series 2010 A Revenue Bonds. Board of Directors’ approval is  
necessary to finalize the refunding and to provide the draft financing documents required to  
complete the transaction.  
Recommendation(s)  
Adopt Resolution No. 2025-008 authorizing the issuance and sale of Orange County Local  
Transportation Authority Measure M2 Sales Tax Revenue Refunding Bonds, Series 2025  
in an aggregate principal amount not to exceed $270 million, the execution and delivery of  
a Fourth Supplemental Indenture, a Purchase Contract, an Official Statement, and a  
Continuing Disclosure Certificate, and taking all other actions necessary in connection with  
the proposed transaction.

OC Streetcar Funding and Schedule Update and Amendments to Supporting

Overview  
The Orange County Transportation Authority is currently underway with the implementation  
of the OC Streetcar project. Staff is seeking Board of Directors’ approval of a revised OC  
Streetcar budget and funding plan. Staff is also seeking Board of Directors’ approval for  
two contract amendments for project management consultant services and construction  
management consultant services needed to support the ongoing delivery of the OC  
Streetcar project.  
Recommendation(s)  
A.  
Approve the revised OC Streetcar Federal Transit Administration Full Funding  
Grant Agreement budget of $649 million.  
B.  
Direct the use of $22 million in Federal Congestion Mitigation and Air Quality  
Improvement Program funds, previously approved for OC Streetcar operations and  
future potential capital needs to be used for the OC Streetcar project and authorize  
the use of up to $47.84 million in Local Measure M2 Transit funding, which will  
increase total funding for the project from $579.16 million to $649 million.

Authorize staff to make all necessary amendments to the Federal Transportation  
Improvement Program, update any air quality conformity requirements, and execute  
any required agreements, amendments, or grants with the Federal Transit  
Administration to facilitate the recommendation above.  
Authorize the Chief Executive Officer to negotiate and execute Amendment No. 34  
to Agreement No. C-4-1854 between the Orange County Transportation Authority  
and HDR Engineering Inc., in the amount of $4,783,234, and extend the agreement  
term through December 31, 2026, for continued OC Streetcar project management  
consultant services. This will increase the maximum cumulative obligation of the  
agreement to a total contract value of $49.3 million.  
E.  
Authorize the Chief Executive Officer to negotiate and execute Amendment No. 24  
to Agreement No. C-6-0926 between the Orange County Transportation Authority  
and PGH Wong Engineering, Inc., in the amount of $6,918,266, and extend the  
agreement term through June 30, 2026, for continued OC Streetcar project  
construction management consultant services. This will increase the maximum  
cumulative obligation of the agreement to a total contract value of $49,700,836.

Zero-Emission Bus Program Update

The Orange County Transportation Authority Board of Directors approved the purchase of  
zero-emission buses and infrastructure to gain necessary operational and technological  
experience in preparation for transitioning the Orange County Transportation Authoritys  
bus fleet to zero-emission technologies. This report provides an update on the  
zero-emission bus program performance and deployment efforts.
